Dear Client, As per the norms you are the tenant in sufferance and all the terms and conditions of the agreement will continue for his over due possession as will be treated as a tenant only in possession. Rest of the expenses which he has deducted depends on the terms and conditions of the agreement of tenancy if these are the clauses that all the maintenance will be paid of the flat by you only then he is right to get deducted the amount out of his security deposit however if there is nothing in the any clause of the tenancy agreement he can not deduct and all burden of the maintenance of the premises goes to his shoulders only and if he is deducting the amount unlawfully you can challenge it in the court as illegal and also recover some damages and compensation from him for giving you pain along with all the cost of the case. For further legal assistance you can send me a PM (Personal Message) through this site. Advise. With Regards !! Anand Bali, Adv. (B.Com., M.A., LL.B., M.B.A.) Supreme Court of India
