1. First option is to send the legal notice and ask him to vacate. If he doesn't vacant then you need to file suit for injunction. 2. Instead of that we suggest to file an injunction suit and get the stay against him. Further amend the suit for injunction and declaration suit. Feel free for any assistance

Reclaim my mother's house title documents

We are 9 siblings of the same Father-Mother. 7 daughters 2 sons. I'm the second daughter. During 1991, my mother pledged/sold our house title documents to a local money lender for Rs.30,000/-. Father died in 1976 & mother in 2012. One of my brother(60yrs) is staying, along with his family, for more than 42 years in the house that has been pledged and has made intermittent payments to the money lender by cash, total amount aggregating to more than Rs.6,00,000/- as of Jan 2012. The money lender visited my brother during 2015 and suggested that he settle a one time amount & take back the house titles. But since then, the money lender is not to be seen. We do not have his address. We tried to trace him(& his family members) but no success. The electricity bill to-date carries our mother's name. What is the legal remedy to get back our house title document & get the house registered to my brother ? The other 7 siblings & their children have no objection to register house title ownership to my brother.
