yes u can still get a divorce on the ground of cruelity which is a valid ground of divorce as per the hindu marraige act...you dont need to get the concent of your husband for this..

Absolutely. You are entitled to not only divorce but also maintenance for the period you remain unmarried. A section 13 petition will have to be filed for seeking divorce before a family court.

divorce could be filed in two manner. one is mutual and other one is by filing case. in second case, you need to prove the conditions which is making you to take decision of not moving further with married life with him. there are grounds of divorce mentioned in Hindu Law. for further discussion you can contact me on 9958454480

Alimony

I had inter faith marriage, I'm Hindu by birth and my husband is muslim. I got converted as muslim during marriage and changed my name is gazette as well. Now due to dowry issues I wasn't able to have a happy life with him and he had filed divorce and asking for my sons custoday. Though I'm denying to offer divorce for my sons welfare. If the case goes in his favour I'm not ready to give my sons custody as he is getting remarried and has not stated that in divorce papers. So my question is he denying to pay alimony to my son and me stating he wants the child custody. Even if he agrees he is ready to pay a very less amount for my son and though he is wealthy and is at good job he has got his assets in his moms name and referring in court has he doesn't have any assets. And another major issue is he is denying alimony to me as I'm employed. And my lawyers states tat he can deny alimony to me as I'm employed but unless I'm employed how can I afford my son's studies, food and day today life expenses. If he is paying me alimony I can be a stay at home and take care of my son completely. How do I get alimony for my expenses as well. Kindly guide please. TIA

Hi. I have been married for few years. My husband was a green card holder Indian citizen during the time of marriage.Our marriage is not registered as he said he will do it after the citizenship. Last year he got his citizenship after that he started threatening me divorce. But still 2 times after that he met me and said he wants the marriage. Few months back he changed his phone number and even his parents who reside in india claim that they don't know his number. His parents are currently in india only due to covid. Once the international flights start they will also go to usa. After that I will never be able to find him. I just want to know what are my options here to claim maintenance from Him as over the years he hasn't taken care of me or given me even the basics and also to know is it legally okay he changed his number while being married to me and neither he or his family are giving it to me. In the years of marriage I have been put through immense torture.
