You can file divorce on the ground of cruelty. Moreover you can also file a complaint under domestic voilence act or under 498A ipc being subject to cruelty. When u wll put pressure on him he will himself come to you for mutual divorce. You can always demand for maintenance or alimony and also litigation expenses. If you have any child u can file an application for custody of that child These all situations will put pressure on him but again it is going to worsen ur relationship with your husband. Go for it only if you strongly being subjected to torture and want divorce.

Dear Client, You can file a divorce petition in the respective family Court on the grounds of cruelty by your hubby as enumerated one of the grounds set out in section 13 Hindu Marriage Act. In addition to it, you can also file a criminal case under section 498 (a) IPC against your hubby and relatives of your hubby.

divorce could be filed in two manner. one is mutual and other one is by filing case. in second case, you need to prove the conditions which is making you to take decision of not moving further with married life with him. there are grounds of divorce mentioned in Hindu Law. for further discussion you can contact me on 9958454480

Hi, Regarding your query. Yes, you can proceed to file divorce against your husband provided you have sufficient grounds for cruelty. This can be expanded and explained to the Judge and you can proceed with a Divorce. I would suggest you initiate contact to further guide you.

And that was within 10 days of warning. 5. She never participated in divorce case I filed and already the divorce is in effect since Nov 2024. 6. She is NRI for last 16 years and our marriage is 25 years long. Without going into the merits of the 498A case allegations, can I request High Court to quash the FIR as it has been lodged in retaliation and the sole purpose is to intimidate me and my relatives.
