yes, as per the provision of matrimonial laws husband is boundbto maintain his wife and children if they are not able to maintain themselves. in order to get benefit from this law you have to prove that the wife is able to maintain herself. for further assistance contact.

If husband is mentally or physically fit then even he is not working, he is liable for pay maintainance to his spouse

Yes, he is liable to pay, but since he is not working he can be awarded a minimal amount to be paid until he works. But that depends on the lawyer and his pleadings.

as per the maintainance laws im our country the husband is always liable for his children and his wife. you could file a case u/s 125 for maintainance. The earnings of the husband are seen only to determine the scale of mainatainance and if he is not working then his property and other assets can be attached.
