First of all I am sorry for a late reply, was held up in work. In your scenario as written above big financial help or as we say maintenance is granted by the Court if children stay with mother. Time for divorce depends upon case to case. If your husband will file several frivolous applications then it might take more time else going by the procedure, it will complete within an year's time. Hi Palak.in present case as state by you, the financial burden on husband to maintain child is purely depends on his financial assistance and earning capability. Our legal system do take care of men rights and seeing the circumstances decides the matter. Here Court will also see the financial and earning capability of wife who is working. Wife who is educated but not working, will also affect the decision of the court in calculating the maintenance % towards children. hi Palak, financial burden on father depends on his financial status and earning capability. If you are also working than Court may decide 50-50 share of maintenance for the childern. and if you are not but educated, than court will estimate you earning capability of being educated and than may decide the financial assistance from the husband. Avoid paying alimony or maintenance

I am a goverment servant. I got married to a girl, also a govt servant in 2004. We hardly stayed together for abt 2 months and she went away to different area by asking a transfer without my consent. I got an exparty divorce in year 2009 and got remarried to another girl in year 2010. Presently i am living with my present wife and have a kid. In the meantime my ex father in law filed a false fabricated case under 498a in varanasi. The case is at stay from allhabad highcourt. Now after 10 yrs my exwife called up and demanded for money. She is employed in central government in scoentific cader post. We had no kids from exmarriage. Can she file up case demanding for alimony or maintainance?? If she does how should i proceed?

How to quash my f.i.r.?

My wife lodged an f.i.r. u/s 498a, 377, 323, 504, 506 and 3,4 of the d.v. act. Meditation process is going on. Due to lockdown court is closed and mediation dates is not going to happen in few months. My wife want to compromise it in police station and told that the compromise deed will be sent to mediation. My question is after that compromise it my f.i.r. will be quashed automatically or i have to go for quashing u/s 482. My second question is that can my wife lodged any type of false f.i.r. after quashing this f.i.r. on future. After f.i.r. no proceedings are started yet. Only f.i.r. is done and matter send to mediation.
