How can I send the legal notice to the other party for division of property as per the registered will??

Dear Sir/Mam, Please note I have the copy of the registered will. As per the will, the property should be equally divided between two parties, but the other party is not ready to vacate the half portion. Please advice. Thanks/regards Vinod Lamba

This is my response to you: 1. If the other party does not agree then file probate petition; 2. Once the court divides the property then the property is equally divided as per courts order; 3. If he still creates a dispute then file a suit in the civil court.

PROPERTY TRANSFER FROM FATHER TO SON - FOR HOUSING LOAN

Dear sir, My name is Mahesh, Aged 36. I work in a Public Sector Bank. I wish to demolish and reconstruct my house in Kerala as it has become a very old structure. The existing house is an independent building in a plot of land of 18 cents and is in the single name of my father Aged 69. The property has nil encumbrance. As I work in the Bank I have to transfer the property from my father to my name to avail Housing Loan. My father's legal heirs are my Mother, Myself and my younger brother who have consented to transfer the property to my name. Tenant is refusing to vacate the property

My father has let out a commercial property to wholesale fruit merchant, since he was defaulted in paying rent, after completion of tenor we filed a case and got eviction order almost after 6 years. Tenant is a Muslim guy, somehow he managed police by bribing. Instead of acting on court orders, police took more time for accommodating tenant to approach higher court. By making allegations against judge, he approached higher court. Now there’s no judge in the said court. Officiating judge is simply giving fresh date. Almost after 15 months no progress in the case.. In between my father also passed way.. I don’t know how to go about it. Advocates expressed inability. Kindly suggest me for speedy disposal of the case.
