How can a husband state the he doesnt have a job and refuse to pay any settlement amount for a mutual divorce

I have 2 kids and asked my husband to pay for education he refused saying he doesnt have a job

There are many judgement which says he can not escape from his libility . If he does not have job still he has to meet his liability.

File an application in the court through your lawyer stating that u r not getting the maintenance..

Dear Client, you may ask through your lawyer about his earlier jobs and also his capacity to earn based on his education. the court may ask to pay a lum sum amount for your and children maintenance. This is his liability too, which he has to fulfill. He can not deny or rid off from his responsibility and liability.

A Hindu male is legally obligated to maintain his spouse. Maintenance includes provision for food, residence, clothing, education and medical attendance and treatment. A jobless husband cannot deny maintenance to wife, but a jobless wife can claim maintenance from husband. In Shailja & Anr. v. Khobanna case, the Supreme Court made a remarkable observation by stating that merely because the wife is capable of earning it is not a reason to reduce the maintenance awarded to her and said that whether a wife is capable of earning and is actually earning are two different factors.

It's a moral obligations/ duty of both spouse to maintain their child ,so under DV act 2005& u/s 125 Crpc you applied for maintainace

498A case FIR quashing

At this juncture and given the fact of Supreme Court ruling of 2 days back ““Nitin Ahluwalia vs The State Of Punjab on 18 September, 2025””, I am thinking to file an application in Delhi High Court to quash the FIR as the 498A case was filed 1. She filed 498A case after 4 years of Separation. 2. She filed 498A case after 3.5 years of me filing the Divorce application. 3. She herself started the Divorce wish in Canada in June 2019 by sending notice to me. 4. She filed 498A case in retaliation to my warning of Not to touch my 12 Lakh Rs. And that was within 10 days of warning. 5. She never participated in divorce case I filed and already the divorce is in effect since Nov 2024. 6. She is NRI for last 16 years and our marriage is 25 years long. Without going into the merits of the 498A case allegations, can I request High Court to quash the FIR as it has been lodged in retaliation and the sole purpose is to intimidate me and my relatives.
