Filed divorce case .

I live at abroad alone.my wife with her family. she dont want live with me and tried to give false dowry police complaint against my parents. Now i filed divorce case.next month i have 1st hearing. i get fear may she give again false dowry complaint against my parents on 1st hearing.please tell me what are the question will ask to me or what are the procedure in 1st hearing.?

First of all on the 1st day of hearing the opposite party appear before the Learned Court after receiving summons and file their written statement on that day. So at the time of evidence you need to suffice sufficient evidence to prove that it was a false dowry case.

Dear client, 1st hearing means nothing to worry like the court will ask whether you want to for mediation process and if both the parties appeared before the court then you can go for mediation process to settle the matter before the mediation process..!

Hi, Nothing to worry as such she cannot give complaint when you had already filed divorce case against her and as per the first hearing is concerned on that day the judge may send both the parties to mediation process where you can settle the matter through mediation process.

As this is the first hearing there will be no questions asked. Court will give an adjournment for filing of the reply/written statement. Well judge may try to compromise your matter.

At this juncture and given the fact of Supreme Court ruling of 2 days back ““Nitin Ahluwalia vs The State Of Punjab on 18 September, 2025””, I am thinking to file an application in Delhi High Court to quash the FIR as the 498A case was filed 1. She filed 498A case after 4 years of Separation. 2. She filed 498A case after 3.5 years of me filing the Divorce application. 3. She herself started the Divorce wish in Canada in June 2019 by sending notice to me. 4. She filed 498A case in retaliation to my warning of Not to touch my 12 Lakh Rs.
