Sir in this case, you can directly file a case for divorce on ground of cruelty or you can also file a case for restitution of conjugal rights asking the court to join you and lead married life, further regarding her threatening you of filing false cases recently the supreme court has given directions that there will be no automatic arrest in such cases, the court has given guidelines to be followed by police and now if she files a false case and register an Fir you and your family can get anticipatory bail and defend the case, further she may file maintenance or domestic violence case in which no bail is required and you can defend by engaging an advocate, further you can also ask for custody and visiting rights in divorce petition itself.

In case you wish to stay with her, and she has withdrawn from her matrimonial obligations without reasonable cause, you can file a petition for restitution of conjugal rights. However in case there is no scope of reunion, both the parties should try and separate amicably. Filing a False FIR against Husband and in-laws is a common practice these days, however, filing a false FIR is still easy but proving it in court is a herculean task. By way of abundant caution you can file a NCR complaint in the concerned police station, stating that you are receiving such threats. It will take me time to move out because I am still a student. my dad is going to get retired next year and all he does is sleep and watch TV in these 30 years. if my mom files for divorce how much share she will get? I am above 22 btw. give some advice
