You can not proceed for Divorce until you complete One year. However, on certain circumstances you may move for Mutual Divorce

498a quash and mutual consent divorce.

Respected sir, My brother's wife has filed 498a case on my brother who is in overseas. Our lawyer said he has recalled NBW in lower court and filed 498A quash petition, under Section 482 of the CrPC in the High Court. Lawyer attended one hearing and he didn't present well ( he didn't talk much).Lawyer is not attending high court and advises that current judge may not be favorable ., still the quash petition is in pending status from last 12 months. We paid 2.5 lacs to lawyer till now. Meanwhile other party's lawyer has responded to quash petition which is still pending and approached our lawyer for settlement and mutual divorce. My lawyer is not responding properly and he is putting the same condition as opposite party to pay lumpsum amount settlement even before withdrawing the 498a case. My brother is unemployed now ,our lawyer is not even checking the conditions laid by other party properly and he is saying my brother can come to India now as NBW is recalled. We already gave 2.5 lacs fee to lawyer and still asking for more money. We feel its too much money, normally what is the fee for lawyer for recalling NBW , filing quash petition and mutual contest divorce? Can my brother travel to India as lawyer is advising that he cant find LOC ?

Husband and family not responding when contacted

Hi all, i married my husband in aug'24 and we are separated from my husband in aug 25, due to him sitting on my face and asking me to lick his ass( he was clothed, but i felt disgusted) majorly and also due to his and his parents frequent harassment for money, from my parents and them saying I shouldn't stay with my husband. I got to know i was pregnant in sep'25 and i reached out, but he didnot pick the call. In feb, multiple relatives called my father in law and husband, but they didnot pick the calls nor did they answer the door when they went to their house. Today my father tried to call both my father in law and husband, but seems they have blocked the call. I tried to call my husband, and he is still not picking up. What action can we take legally, as we no longer want anything reconciliation.
