Which Businesses come under Shops and Establishments Act License?

Registration

  1. Each establishment is required to be registered under The Delhi Shops Act, 1954 within 90 days from the date on which the establishment starts to work.

  3. The owner will within 15 days of his end of the establishment, tell the Chief Inspector and have it recorded as a hard copy as needs be.   4. A Registration Certificate shall be renewed at an interval of every twenty-one years.

Employment & Working Hour

  1. "Young person" signifies an individual who isn't a tyke and has not finished his eighteenth year of age.

  2. "Adult" signifies an individual who has finished his eighteenth year of age;

  3. "Child" signifies an individual who has not finished his twelfth year of age;

  4. No adult shall be required or permitted to work in the matter of an establishment for over nine hours in a day or 48 hours in any week. The occupier will fix the day by day times of work as needs be. Amid any time of stock-taking or creation of records or some other reason as might be endorsed, any grown-up worker might be permitted or required to work for more than the hours fixed in this area, yet not surpassing 54 hours in any week.

  5. In any case, the total hours so worked shall not surpass 150 hours in a year. Advance intimation of three days in case of extra-time has to be given in the recommended way to the Chief Inspector and any individual utilised on additional time shall be qualified for compensation for such extra-time work at double the rate of his typical compensation determined continuously.   6. The time of work of an adult worker in an establishment every day will be fixed to the point that no time of nonstop work will surpass five hours and that no representative will be required or permitted to work for over five hours before he had a term for rest and dinners at any rate 30 minutes.

  7. The ideal opportunity for such term will be fixed by the business and intimated to the Chief Inspector seven days before such compulsion and will stay employable for a time of at the very least three months.

  8. The times of work on any day of an adult individual will be arranged to the point that including his rest or lunch/dinner as required under segment 10, they will not spread over for more than ten and a half hours in any business establishment or for over twelve hours in any shop.

  9. No young person will be required or permitted to work whether as a worker or something else, in any establishment even if the kid is an individual from the group of the business.

  10. No young person will be required or permitted to work in the factory for over six hours every day.

  11. No young person will be utilised ceaselessly for more than three and a half hours without an interim of in any event thirty minutes for rest or dinners and the spread over will not surpass eight hours.

Regulations under the Act

This act lays down the following rules:

  1. No. of working hours for the employees per day and week.

  2. Important instructions and rules relating to and for spread-over, rest interval, opening and closing hours, closed days, overtime work and national holidays.

  3. Rules governing the employment of children, young adults and women.

  4. Rules governing annual leave, maternity leave, sickness and casual leave, etc.

  5. Rules for employment and termination of service of the employees.

  6. Rules governing maintenance of registers and records and display of notices.

  7. Obligations of employers as well as employees towards each other and the business.

How to Apply for Shops and Establishments Act License Registration?

Every business owner of any shops and establishments are compulsorily required to get the registration under the Shops and Establishment Act. Here are the following steps:

  1. First submit an application in the prescribed manner and form to the Inspector of your area within 30 days of starting any work in your shop/establishment. Additionally, you need to submit the application along with the prescribed fees which should contain the following information:

  • Your name as the employer and the name of a manager, if any;

  • The postal address of your shop/establishment;

  • The name of your shop/establishment;

  • Telephone No

  • Email Address

  • Nature of Business

2. Date of Commencement of Business

After receiving the application for registration and the fees, the Inspector shall verify the reliability and correctness of the application. Once he is satisfied, he shall enter the details in the Register of Establishments and issue a registration certificate of your establishment to you. This certificate is valid for 5 years. And you need to renew the thereafter. After getting the certificate, you will need to display that at your premises.

If you wish close down your establishment, within 15 days of closing the establishment, notify the Inspector in writing the date of such closure and return the registration certificate. After due verification, the Inspector shall remove the name of your establishment from the Register of Establishments and cancel your registration certificate.
