Wife Accused of Running Fake Marriage Racket by the Deserted Husband; Police Directed to Verify by Delhi Courts

Remember Bollywood movie Dolly Ki Doli, this story is straight out of that movie where woman marries several men with the purpose of extorting the money from her husbands.

The petition has been filed by Balwinder Singh, resident of Siraspur village in outer delhi to blow the fake marriage racket run by his wife Shalu in the Rohini Court. It has been alleged that Shalu alias Malkit Kaur has allegedly done many marriages and further deserting her husbands including Balwinder Singh and in some cases she has even deserted her child born out of the wedlock which led one of her husbands to land in mental asylum.

Balwinder Singh has sought from the court that FIR be registered against Shalu alias Malkit Kaur and her relatives for cheating, criminal conspiracy, fraud and criminal intimidation for deserting him and their minor child.

Prashant Manchanda, advocate appearing on behalf of Balwinder Singh told the court that police has not taken any step for the registration of FIR in this case and during the personal investigation by the husband it has been revealed that Shalu alias Malkit has been married before several times and have deserted all her husbands by threatening them with extortion. It has been further submitted by the advocate before the court that verification of the status of early marriages has not been done by the police.

Metropolitan Magistrate Neha Gupta Singh has directed the IO to verify the status of earlier marriages and file a report regarding same before the court on next hearing date and has also directed the IO to be present in the court on January 12, which is the next hearing date.

Facts of Complaint-

It has been alleged in the complaint that Shalu’s relatives had approached the complainant husband Balwinder Singh around November 2011 with the prospect of marriage. Later, in 2014 a son was born out of the wedlock and soon after the accused’s behaviour changed and she started misbehaving with the complainant and his family. It has been further alleged in the complaint that she threatened to file false complaint against the complainant on the grounds of dowry harassment, domestic violence in case her demand of Rs 10 lakh is not fulfilled. It has been further alleged that she later deserted the complainant and their minor child. 

Balwinder Singh made all the efforts to reconcile the marriage and bring his wife back to the matrimonial house however all the efforts went futile. Later he did a personal investigation which revealed that she has already been married thrice before marrying Balwinder Singh.

On confronting Shalu alias Malkit’s relatives they blatantly told that she is now off to uttar pradesh to marry someone else.

The police did not paid any heed to register the FIR and aggrieved by that the complaint has been filed before the court. It has been prayed in the complaint that FIR be registered against Shalu alias Malkit Kaur under section 494, 495, 420, 384, 387, 506 and 120B of IPC.

Story of first husband-

The advocate appearing for Balwinder Singh further put forth before the court that Shalu alias Malkit married her first husband Surinder in 2006 and she has a son born out of this wedlock too. The first husband is presently in a mental asylum in Shahdara.

A settlement has been reached between her and Surinder in year 2009 that she will drop the case of dowry harassment against him and will not demand any maintenance from him. The settlement was later dishonoured by her as the case against him has now reopened by the Shalu alias Malkit.

Shalu aka Malkit further married Sanju in 2008 followed by one Jasvinder Singh. A son was also born out of the wedlock with Sanju who presently lives with Sanju.

It has been sought by the complainant that the police be directed to bust this fake marriage racket.
