Permission from Bombay HC sought for Termination of Pregnancy by 13-year old Rape Victim

A petition for seeking termination of pregnancy by a 13 year old rape victim has been filed before the High Court of Bombay.

Justice SS Kemkar and Justice GS Kulkarni have directed the medical experts from KEM Hospital to submit a report on whether the termination of pregnancy would be safe for the girl or not after examining her condition.

It was submitted in the petition that the pregnancy was determined after the complaints of abdominal pain by the victim on 7 november followed which she was taken to the doctor. It was further submitted in the petition that the victim was raped by her own cousin brother who used to live with her family.

The Medical test revealed that the victim was 24-weeks pregnant. Further an FIR was registered on November 17.

It has been stated and argued that the pregnancy should not be forced on the victim as forcing of pregnancy would deprive of her right guaranteed under Article 21 of the constitution of the procreation, motherhood and childbearing.

The Medical board has been asked to submit the report by the December 5th.
