Court alleges Senior Lawyer for helping the Accused in Junaid Khan Murder Case

The judge in its interim order stated that Additional Advocate General Naveen Kaushik was seen helping and assisting the counsel of main accused during cross-examination on two dates. Justice Rathore further pointed out that the Advocate Kaushik was suggesting the questions to be put forward to the witness.

The Additional district and session judge Y.S. Rathore of the trial court in faridabad hearing the matter of Junaid Khan murder has raised allegations and has sought actions against the senior government lawyer for helping the accused of the murder of 15-year old Junaid Khan.

The judge in its interim order stated that Additional Advocate General Naveen Kaushik was seen helping and assisting the counsel of main accused during cross-examination on two dates october 24 and october 25. Justice Rathore further pointed out that the Advocate Kaushik was suggesting the questions to be put forward to the witness.

While recording the order, Justice Rathore said that the above act on part of Advocate Kaushik amounts to professional misconduct and is against the ethics of legal profession. It was further observed that it is a very sensitive case where as per the prosecution a boy of minority community has been killed by the people of majority over the quarrel of sharing seats in train. Justice Rathore noted that that such an act on part of Advocate Kaushik will create insecurity in the minds of victim’s family and will adversely affect the aim of court and right of the victim to get free and fair trial.

A letter has been forwarded to the Punjab & Haryana High Court, Chandigarh for taking up the above matter. The matter will be taken by the state government, office of advocate general haryana, Bar Council of Punjab & Haryana, Chandigarh for necessary actions.

However, defending himself Advocate kaushik said that the court is under wrong impression as there was no assistance was given to the counsel of accused on his part as he was not appearing in the matter. He was present in the court as he was the organising secretary of the Bharatiya Bhasha Abhiyan as the counsel of the accused has requested the court to record evidence in hindi.
