Is a Borrower Industrial company a CONSUMER

We have taken loan of Rs. 330 lakh for installing a factory from the Bank. Due to some reason, we could not run the factory profitably and compelled to sale the factory, because due to default in repayment of loan and payment of interest, the account has been classified as NPA. Since we were not in position to lose the buyer of our factory, were compelled to make the payment as demanded by the bank. After getting no dues from the bank, it was revealed that bank has wrongly debited substantial amount in our account as charges and also charged interest at higher rate. We have approached the bank to reconcile the account and refund the wrongly debited charges and interest, but the bank did not pay any heed on out request. We have submitted an application before the District Consumer Redressal Forum . Now the bank has filed its initial objection and argued that since the Borrower is a Incorporated Entity engaged in business/commercial activities and the loan was provided by the bank for industrial/commercial purposes, the Borrower does not come within the purview of “CONSUMER” as per the Act. Please provide us guidance on the following issues: 1. Is our Company can not be termed as CONSUMER ? 2. Is loan for any commercial activity beyond the coverage of Consumer Protection Act ? 3. Are there some findings of High Courts and the Apex Court against or in support of us ?

The matter involves a claim for a refund of fees amounting to INR 38000 and assistance with filing a claim in the Consumer Court, Jaipur. My objective is to resolve the issue promptly, preferably within a single hearing if possible. To recover legal costs from the offender The university holds government accreditation and is bound by UGC regulations. The key points relevant to this case are as follows: 15-Day Refund Rule (Clause 4.1.5): If a student submits a written request to withdraw their admission, the institution must refund the fees within 15 days of receiving the application. Delay or Denial Constitutes a Grievance: As per the UGC (Redressal of Grievances of Students) Regulations, 2023, if a student withdraws admission within the allowed timeframe and the institution delays or refuses to refund, it is classified as a student grievance. Consequences of Non-Compliance (Clause 6): Failure to comply with refund rules may lead to punitive action under: Clause 5 of the UGC Notification (October 2018) regarding Refund of Fees and Non-Retention of Original Certificates Clause 6 of the Refund Policy 2024–25 The Consumer Protection Act, 2019, as the refund was not issued within the legally mandated period for a paid service that was not provided. Stock broker ignored closure request, charged demat account maintenance fees for 5 years

Respected Sir/Madam In 2019, I requested ICICI Securities to close my Demat account. A few days later, I received an email stating my trading account was closed, but there was no mention of the Demat account status. Assuming the account was closed, I forgot about it. Recently, in April 2024, an ICICI executive informed me that my Demat account was still active. Upon checking my bank statements, I realized I had been charged ₹826/year since 2019. I registered a complaint on the SEBI SCORES portal. Initially, ICICI Securities responded by saying my trading account was closed, not the Demat account, and that the Demat account was closed in April 2024, making the charges legitimate. I appealed, and ICICI Securities replied to the SEBI Scores portal, stating: "This has reference to the complaint dated 09-05-2024 and 13-05-2024 of Complainant pertaining to the closure of the account for UCC: XXXX. As per our records, we would like to state that: 1. The complainant's trading and Demat accounts were permanently closed on 21-JAN-19, with no funds/securities in these accounts. 2. For bank account-related concerns, please contact the bank. Yours faithfully, ICICI Securities Limited." Despite this, they maintain that the account was closed in April 2024, not January 2019, and have wrongly charged me since 2019. I escalated the matter and lodged a complaint on SmartOD with the depository (NSDL) and ICICI Bank. Their response was as follows: 1. The reply is from ICICI Securities (above reply of account closer on Scores), not ICICI Bank. Since ICICI Securities has acknowledged that the account was closed, they advised me to include ICICI Securities as a party and raise a fresh appeal. 2. I submitted a new complaint, making NSE and ICICI Securities parties to the issue. However, the response stated that the Demat account falls under ICICI Bank, not ICICI Securities, and therefore, ICICI Securities cannot assist in this matter. Although ICICI Bank and ICICI Securities are both part of the ICICI Group, they are still causing unnecessary harassment. Kindly suggest how and where I should complain to get my refund back. Regards, Vishwanath
