The wife whose husband is in an extra marital affair, has “no legal remedy” which can establish criminal liability for his disloyalty so there is no punishment. Not even the woman with whom the husband establishes a sexual relationship outside the marriage can be prosecuted under the Cr.p.c but if she is married then the husband can be held liable for adultery under the Indian penal code.

The extramarital affair is a part of the mental cruelty, the wife can take divorce on the basis of this issue the definition of the term cruelty is defined and explained in section 498 A of IPC, 1860. Thus extramarital affair is also one of the major ground for taking divorce.
