What if the company is not giving me appointment letter and terminate me without notice period? Can I do anything in legal matters?

The company is following hire and fire policy. The company doesn't give appointment letter and say it is probation period. The company is not following HR policies.

Your facts indicate the case of unlawful termination. Kindly note, for private employees (who do not fall under the category of workman), and even if there is no employment agreement, the Company needs to follow a general standard procedure. There are several case laws upheld by Supreme Court and various High Courts, where even the Company having the power of immediate termination of employment, the procedure used by the Company has been held illegal and liable for unlawful termination as they failed to comply with certain general legal principle of law and exit procedure of the employee. A detailed analysis of your employment, communication with your employer, exit policy of the Company and other facts should be analyzed. Therefore, you may connect with us at 08448824659 for further discussion to raise the issue of unlawful termination and other suitable claims against the Company. Dear Sir, You can raise the issue before Labor Commissioner. He has rights to adjudicate the matter at his level and if the employer not co-operating then the matter will be refer to industrial Tribunal under Section 12 of Industrial Disputes Act. Please go to my Profile on this site (Myadvo) and Review and Rank me No.5 and call me for more legal advise.

Hi, want to check eligibility for severance pay and notice period pay after wrongful termination as a result of retaliation

Hi Team, I joined FYERS as VP - CS and sales on 16th jan'24 however they ended my employment suddenly on 5thApr'24 in retaliation since I reported continued hostile, intimidating and unprofessional behaviour by SR. Manager sales on 3rd Apr '24 in writing to VP -HR of FYERS. As a result FYERS moved one of my KYC process to another VP on 4th Apr and ended my employment on 5th Apr'24. They withdraw my access to all systems, emails and chat on 5th apr'24 itself and FYERS -HR send me a email that I have resigned and is not equired to be available in office for next 15 days of notice period when I haven't resigned till today from FYERS. When I questioned them and asked them to share my resignation. They created new story saying that I there was difference in expectation between them and myself about role. When I challenged that saying CEO himself was appreciating me and all. They said, I resigned since my performance was an issue during probation period of 3 months when they never issued any mail Or notice to me on my performance till today. They haven't paid me my notice period pay of 20 days for Apr'24 nor have paid me any severance pay which I requested nor have issued me any relieving letter. In fact they send me full and final payslip yesterday for Apr 24 showcasing LOP days -20 . What can I do in this case, pls guide.
