Is it not against the HR policy in a MNC to make someone work for consecutive 9 days with out a split-off.

Maternity Bill 2017 not applicable for schools?

I am a confirmed teacher in a private unaided school in Mumbai for the past 10 years. I have applied for maternity leave only to be told by the HR that 90 days paid leave is given. On being questioned about the Maternity Benefit Amendment Bill 2017 the HR referred to the 1961 Act definitions given of which establishments are covered and showed me that schools are not mentioned hence 26 weeks paid leave is not applicable. I want to know how is this possible that schools do not come under the Act when the whole of India is eligible for it.
