Need guide regarding 138 Ni case filed against me

Hello, Due to my financial circumstances, I had defaulted payment 2 installments of my home loan. The bank had earlier taken blank cheques as security. They have now filed a 138 NI case for cheque bounce. The case is filed in Gurgaon court & I stay in Pune. Would it be preferable to hire a lawyer from Gurgaon ? What would be the legal fees for the same ? Regards, Chaitannya

I can advice you through the procedure but I will require more information regarding your case. NI Act involves many technical aspects like when the cheque was signed, what was the reason for the dishonour of the cheque, whether notice of dishonour was served to you or not, in case it was served to you then when was it served and did you reply to the same. I also require information that whether there are any liability regarding the nigotiable instrument that got dishonoured. But the most important information which is required here is that what is the stage of the proceeding of the court. Whether court has taken cognizance in the matter or not. Without information regarding to the aforementioned quarries it will not be possible for me to provide you any guidance.

Dear sir, I had recently filed SLP in supreme court against impugned order given by Bombay High Court on my PIL. The PIL was filed to pass order for Election Commission of India to implement the suggestions given by me to ECI. On the day of hearing, Hon. Supreme Court jude told us that your SLP has merits but there are some loopholes in the representation made to Election Commission of India. Hon. SC judge asked us to withraw the SLP and make fresh and modified representation to ECI. Now, my question is that what if ECI does not accept the modified sugestions too. I read that one can not file PIL on the same subject again in supreme court. In my case, can I file PIL in supreme court or any of the high court, if ECI does not accept my sugestions? Please note that the Hon. Supreme Court's judgement only says that, "The learned counsel for the petitioner seeks leave to withdraw this Special Leave Petition. The Special Leave Petition is, accordingly, dismissed as withdrawn". The Hon. judge has not mentioned that he has suggested us to withdraw the SLP. Please answer my question if I can file PIL on this topic in future with modified prayers.

Use of outer space of my ownshop

I own a shop a in basement at corner of Krishna Appartment Building,masani Tiraha, Mathura named SHUBHAM Musical Palace .There is no way to out or in just an ending gallery, if any visitor or customer or any person could stand or visit at that place only having any work from my shop only. There is no way or any dispute comes under that basement wall which I want to be used as a place for shop use only I never violate any law but there is only dispute between flat members of Appartment that they do not want to allow to use such space because of jealousy and arrogance, but there is only space of opposition of my shop which only used by me in future and present. So I want help and suggestions regarding this area to use such place for my shop attributes and stock only nothing else. Please help me I am only person against to mostly flat members and other shop owners have a problem with it .They have also some connection with local police and with them they started bullying and stopped my work and abusing my workers who came to complete my iron racks on wall opposite my shop. Please help me to take initiative action against them
