Need guide regarding 138 Ni case filed against me

Hello, Due to my financial circumstances, I had defaulted payment 2 installments of my home loan. The bank had earlier taken blank cheques as security. They have now filed a 138 NI case for cheque bounce. The case is filed in Gurgaon court & I stay in Pune. Would it be preferable to hire a lawyer from Gurgaon ? What would be the legal fees for the same ? Regards, Chaitannya

I can advice you through the procedure but I will require more information regarding your case. NI Act involves many technical aspects like when the cheque was signed, what was the reason for the dishonour of the cheque, whether notice of dishonour was served to you or not, in case it was served to you then when was it served and did you reply to the same. I also require information that whether there are any liability regarding the nigotiable instrument that got dishonoured. But the most important information which is required here is that what is the stage of the proceeding of the court. Whether court has taken cognizance in the matter or not. Without information regarding to the aforementioned quarries it will not be possible for me to provide you any guidance.

What if I received a summon from court but on that day, that court in on leave?

I received a challan summon in March. But on that particular I went to court and found that the court was on leave. So, I again received a summon in April. Same thing happened again as court was on leave again. Now I bai received any summon after that. Will there be any issue for me?
