NO.. NOT AT ALL.. it all depends on the merit of the case.. if she is getting maintenance from you in another proceeding also , then she is not entitled to... Even if we look into this section also, then also various grounds and merits have to been seen..

Not really. It depend on case to case. If your wife has filed any other case for maintenance and she is receiving maintenance from other case then any maintenance awarded in 125 case would be set off against the maintenance of other court. Secondly, it always depends on how strong is your case.

WRONG FSL DONE SIGNATURE OF CHEQUE WITH CHANGED SIGNATURES

In my case a person given a cheque for Rs.1 Lac bearing his signature. this cheque returned unpaid with insufficient funds remarks. we have sued him under section 138. accused filed fir in separate court that sign on cheque and account is not opened by him so direct the police to send this cheque to fsl.
