How much will it cost to get legal advice for filing a case in consumer court for no compensation for delay in newly constructed flat handover ?

As per the contract the handover date was June 2017. They then moved it to February 2018. They have still not handed over the flat, due to issues and finishing not done, however many others in the apartment has already moved in . They have further delayed it and are not even responding to mails.

yes, you can file a compliant before Consumer Forum. Further, please refer to our buyer agreement or flat agreement which was signed at the time of allotment. Most agreement contain a clause that compensation may be paid for the delay caused

the fess for legal advisory depends from lawyer to lawyer we have to anaylize whether your building falls under RERA or consumer court accordingly we shall take course of action

The legal advice will cost you around Rs. 15-20000 depending upon your case. Prima Facie you deserve the compensation if the promise is not fulfilled at the right time by the builder hoping that you haven't made any promise in return or you haven't allowed them to extend the time or you haven't paid the consideration at right time etc.

You can very well file a consumer complaint.The correct forum to file the consumer complaint must be decided as per the actual cost of the flat irrespective of the fact that how much you have paid for the booking of the flat. The pecuniary jurisdiction of the consumer courts are for District Forum: upto Rs 20 Lacs, State Commission: Rs 20 Lacs to Rs 1 Crore, NCDRC: above Rs 1 Crore.

you can fight your own case before consumer court. there are as such no filing procedure before consumer court.

If there is a delay on the part of the builder in handing over possession, you have an option to either seek full refund with interest or still seek possession (under court orders) with interest and compensation. But first, you would be required to send the builder a legal notice regarding the delay in handing over of the flat. Also, it is advisable to click latest pictures in support of your case before the Court to show non-completion of construction work. However, one has to be very sure of any hidden loopholes in the Agreement, such as any extension or grace period granted to the builder in the agreement.

Stock broker ignored closure request, charged demat account maintenance fees for 5 years

Respected Sir/Madam In 2019, I requested ICICI Securities to close my Demat account. A few days later, I received an email stating my trading account was closed, but there was no mention of the Demat account status. Assuming the account was closed, I forgot about it. Recently, in April 2024, an ICICI executive informed me that my Demat account was still active. Upon checking my bank statements, I realized I had been charged ₹826/year since 2019. I registered a complaint on the SEBI SCORES portal. Initially, ICICI Securities responded by saying my trading account was closed, not the Demat account, and that the Demat account was closed in April 2024, making the charges legitimate. I appealed, and ICICI Securities replied to the SEBI Scores portal, stating: "This has reference to the complaint dated 09-05-2024 and 13-05-2024 of Complainant pertaining to the closure of the account for UCC: XXXX. As per our records, we would like to state that: 1. The complainant's trading and Demat accounts were permanently closed on 21-JAN-19, with no funds/securities in these accounts. 2. For bank account-related concerns, please contact the bank. Yours faithfully, ICICI Securities Limited." Despite this, they maintain that the account was closed in April 2024, not January 2019, and have wrongly charged me since 2019. I escalated the matter and lodged a complaint on SmartOD with the depository (NSDL) and ICICI Bank. Their response was as follows: 1. The reply is from ICICI Securities (above reply of account closer on Scores), not ICICI Bank. Since ICICI Securities has acknowledged that the account was closed, they advised me to include ICICI Securities as a party and raise a fresh appeal. 2.
