How can I get relieve my wife's mental tourchers?

Hello, my parents are living with my brother, sister in law and there son. my brother has resigned from his job and preparing for engineering exam also my sister in law has some severe medical issue. she is suffering from acute epilepsy. We didn't know about her problem, her mother and elder brother cheated us without telling anything about her illness and they performed marriage in Feb 2015. We knew this thing in oct 2015, when she got fits. She conceived in 2016. Now, the situation is

You may file a petition for Divorce anytime after 1 year of completion of your marriage citing any of the the various grounds available under the Hindu Marriage Act 1955 (in case you are Hindus). As you have mentioned that your wife misbehaves with you, this would fall under the ambit of Cruelty as per Section 13(1)(ia) of the HMA 1955. Under Section 13(1)(ia) the term cruelty includes mental as well as physical cruelty. Mental cruelty has been elaborated upon by the Supreme Court of India to include: “Mental cruelty may consist of verbal abuses and insults by using filthy and abusive language leading to constant disturbance of mental peace of the other party. The Court dealing with the petition for divorce on the ground of cruelty has to bear in mind that the problems before it are those of human beings and the psychological changes in a spouse's conduct have to be borne in mind before disposing of the petition for divorce. However, insignificant or trifling, such conduct may cause pain in the mind of another. But before the conduct can be called cruelty, it must touch a certain pitch of severity. It is for the Court to weigh the gravity. It has to be seen whether the conduct was such that no reasonable person would tolerate it. It has to be considered whether the complainant should be called upon to endure as a part of normal human life. Every matrimonial conduct, which may cause annoyance to the other, may not amount to cruelty. Mere trivial irritations, quarrels between spouses, which happen in day-to-day married life, may also not amount to cruelty. Cruelty in matrimonial life may be of unfounded variety, which can be subtle or brutal. It may be words, gestures or by mere silence, violent or non-violent.” Therefore the behavior of your wife can easily come within mental cruelty. You can get the marriage annulled on the grounds of epilepsy only. It is better than getting a divorce

Firstly its very sad to know. All you can do is file for divorce citing her medical conditions. along with papers and relevant documents.

Necessity of FIR & Chargesheet quashing prayers in 482 application

I want to go for FIR and Chargesheet quashing both in my 482 application pending before the Allahabad High Court after a stay of the same as the complaint belongs to repealed Section 66A of the Information Technology Act, 2000. However, these prayers were not specifically mentioned in my revision petition under 482 as it was dismissed by lower Courts. Can I pray the same in my final arguments or I should amend/add my prayer by an application in this regard separately in the High Court?

wife filed false 498a case against me n parents

my wife who is kerala, has filed a false and wrongful case under section 498a against me and my elderly parents.we 3 live in delhi. i received a call from an ASI saying he has received this complaint and me n my parents need to come to his police station in kerala,sign and collect notice.over watsapp he only shared case number and section.he said if all 3 of us dont personally then we will be marked absconding.going to kerala is an expensive proposition not to mention i cannot take leaves and my parents are over 70 and 65 respectively. what should i do step by step
