Dear, in above mentioned circumstances, there could be two possibility, either present marriage is forceful marriage where consent of your wife was not taken at the time of deciding marriage or some other personal reason for which your wife is hiding. In present scenario as stated by you is a clear indication towards annulment of marriage. since no sexual intercourse has been done so far which is main element of consenting a hindu marriage, same could be filed for annulment of marriage under hindu law. Hope this suffice the need. in case you would like to discuss further you can visit my profile and contact me on binitagaur@gmail.com. thanks

Hi, Regarding your query, there are a few important aspects that need to be looked into,as I understand, you must be under immense distress over your current situation. However, as per what you have stated you have a completely viable case and cause of action against your wife. As you have indicated that you would wish for her to come back and she is presently seeking divorce. Her lawyer will attempt to paint you in bad light in the divorce petition against you, however you have not engaged in any cruelty, or harassment of any kind and no physical assault. Your case appears to be genuine and you would need to engage an able lawyer who can put your case before the Judge. This appears to be a pure case of cheating, as she has neither engaged in any physical relations with you and now is attempting to extort your finances for her benefit. I have dealt with similar cases before so you may reach out for further guidance.

Necessity of FIR & Chargesheet quashing prayers in 482 application

I want to go for FIR and Chargesheet quashing both in my 482 application pending before the Allahabad High Court after a stay of the same as the complaint belongs to repealed Section 66A of the Information Technology Act, 2000. However, these prayers were not specifically mentioned in my revision petition under 482 as it was dismissed by lower Courts. Can I pray the same in my final arguments or I should amend/add my prayer by an application in this regard separately in the High Court?
