Can a legal notice to be sent against loud sound produced in residential building by commercial activities

A gym is running in the basement of our residential building. The gym is playing loud music whole day long, which is creating a unrest. The owner of the gym premises is also staying in the same building. I have already highlighted the issue several times but he is unwilling to solve it. Can a legal notice applicable for such cases?

you can file suit under law of torts on the basis of nuisance along with permanent injunction . Pecuniary damages can also be claimed if you can prove that any wrongful loss has been caused to you as result of his nuisance .

This is my response to you: 1. Has the society granted permission to run the gym? 2. Also the gym's music sound cannot be allowed to penetrate the walls; 3. The walls have to be covered and to be made sound proof; 4. You can complain to the municipal authorities or the police station for the breach of peace; 5. First send a legal notice to the owner.

You can definitely send a notice to the gym owner, and as you said you the gym owner is staying in your building and the issue has been raised with him several times - so if you have documentary evidence of the issue being raised you can also add a clause of mental harassment and willful negligence in the notice.

Hello, you should serve them with a legal notice first. And, if that doesn't serve the purpose then dial no. 100 and call the police and show the notice to the police as well. And, if that doesn't serve any purpose then approach the court. I hope you got my point. All the best!

I received a challan summon in March. But on that particular I went to court and found that the court was on leave. So, I again received a summon in April. Same thing happened again as court was on leave again. Now I bai received any summon after that. Will there be any issue for me?
