PROCUREMENT OF FSSAI LICENSE

The Food Safety and Standards Authority of India (FSSAI) holds the responsibility to issue food license for business operators involved in the business of food and it stands for Food Safety and Standards Authority of India. The government of India is liable for the establishing of standards for the sale, packaging or preservation of food goods in India, which has been integrated by the Ministry of Health and Family Welfare. The Food Safety and Standards Act 2006 has also been implemented.

Similarly, to receive FSSAI registration/license from every proprietary food unit is a major requirement.   Proprietary food means a food product which has not been standardized in accordance with these regulations, but does not include novel meals, individual nutritional food products, special-purpose foods, nutritional supplements, health supplements, nutritional’s and any other food products that may be notified on behalf of the Central Government.

It is vital that the Basic FSSAI Registration is obtained for food companies, such as manufacturers, trade and food shop owners. In addition, the FSSAI License and Basic FSSAI Registration are two categories of food licenses, based on their size or scale.

Any food operator, such as hawkers, small dealers, etc., with an annual turnover of twelve lakhs must be registered in accordance with the FSSAI Law. The FSSAI authority is now unable to accept a Basic FSSAI Licenses registration application other than any proprietary units of food. The categories of business that require a FSSAI registration are as follows:

  • Manufacture
  • Processing
  • Procurement
  • Storage
  • Packaging
  • Distribution

ELIGIBILITY CRITERIA FOR A CENTER AND STATE FSSAI LICENSE

 

 

Criteria for Centre FSSAI License is a follows:

  • Dairy units that have been fitted or process over 50,000 L of fluid milk per day or 2500 metric ton of solid milk per year or milk units that include milk chilling machines.
  • Vegetable oil processing plants, vegetable oils and refineries including oil expeller units which have process capacity of more than 2 metric ton a day by means of the solvent extraction method.
  • Slaughterhouse units handling over fifty big or fifty small animals or more than one thousand poultry birds each day.
  • Units for meat processing that process over 500 kg of meat a day or 150 metric ton a year.
  • All food processing equipment, including re-labeling and repackaging units, process more than 2 metric ton per day, with the exception of grains, cereals and pulses.
  • All proprietary food producers.
  • All 100% Units targeted to export.
  • All importers importing food products for commercial purpose, including food components and additives.
  • Units with a capacity of more than 500,000 metric tonnes, other than those with controlled atmosphere and cold conditions. Cold or cooled storage facilities of over 10,000 metric ton capacity and controlled environment + cold storage of over 1,000 MT capacity.
  • Wholesalers are over.30 crores per year in turnover.
  • Annual turnover for retailers, wholesalers, suppliers and caterers exceeds Rs 20 crores.
  • Hotels with a rating of 5 stars or above.
  • Restaurants with annual turnover in excess of Rs.20.
  • Carriers with a turnover of over 100 cars or over Rs.30 crores annually.

Essential Documents required for the above is as follows:

  • Form B properly signed and completed by the owner or owner of the form.
  • The location's blueprint or layout.
  • Directors' contact details.
  • List of machinery and machinery kinds and information.
  • Photo ID of owner and address evidence issued by the Indian government. The Directors have a picture identification and address evidence for an enterprise. In this situation
  • A water report analysis from a public health laboratory/recognized laboratory.
  • Evidence of property ownership.
  • Pesticide residues report water in facilities making recognized/public health mineral/carbonated water.
  • The manufacturer's NOC and copy of the license.
  • Plan or certificate for the Food Safety Management System.
  • Milk source, if necessary.
  • Source of processing units for meat and meat, as appropriate.
  • Municipal NOC and local authority, if appropriate.
  • Certificate of MCA Incorporation, if applicable.
  • Supporting turnover evidence, if relevant.
  • FSSAI-emitted NOC/PA
  • IE Code for importers issued by DGFT.
  • A Ministry of Tourism certificate, when appropriate.
  • The evidence of turnover for automobiles is supported where necessary.
  • FSSAI Statement Form.

 

Fees Charged by the Authorities:

  • For procurement of a New License- Rs.7500/-.
  • For the renewal of the existing license- Rs. 7500/-.
  • For any kind of modification in the existing license- Rs. 7500 /-.
  • For procurement of a duplicate license- Rs- 10/-.

 

Criteria for State FSSAI License is a follows:

  • Dairy devices, from 501 litres daily (LPD) to 50,000 LPD or 2,5 million tones (METRIC TON) to 2,500 metric ton of milk solids annually, comprising milk cooler unit equipped with milk handling and processing.
  • Vegetable oil processing units and vegetable oil processing units including the oil expeller unit that generate up to 2 metric ton per day or have Rs 12 lakh and beyond a yearly revenue.
  • Slaughter units with capacity of more than two or up to 50 for larger livestock; capacity of more than ten and up to 150 small cattle; capacity of more than 50 poultry birds and capacity of up to 1,000 daily animals.
  • Units with up to 500 kg of meat per day or 150 metric ton per year. Meat processing facilities
  • All units for food processing including re-labelers and repaketeers with capacity up to 100 kg per liter and up to 2 metric ton per day, which include all friction units of grains, pulses and cereals.
  • Storage enterprises with a capacity of up to 50,000 metric ton, except those with controlled environment and cold. Eligibility standards for cold and cooled storage are more than ten thousand metric ton, and for cold and controlled storage storage the eligibility is more than ten thousand metric ton.
  • Wholesalers with up to 30 crores a year. · Retailers, dealers, suppliers and caterers with an annual turnover of up to 20 crores.
  • Proprietors of Dhaba, or owners of other restaurants, clubs and canteens that have 12 lakhs annually.
  •  Hotels which are below 5 stars and have a minimum rating of 3 stars.
  • Restaurants with up to 20 crores turnover.
  • Marketers with 20 crores turning each year.
  • Carriers having an annual turnover of up to 30 crores or at least 100 cars or wagons.

Essential Documents required for the above is as follows:

    • Form B properly signed and completed by the owner or owner of the form.
    • The location's blueprint or layout.
    • Directors' contact details.
    • Photo ID of owner and address evidence issued by the Indian government.
    • List of categories of foods to be produced.
    • Letter of authority containing the responsible person's name and address.
    • Evidence of property ownership.
    • Affidavit of ownership of the partnership.
    • The manufacturer's NOC and Copy of the License.
    • Plan or certificate for Food Safety Management System.

 

Fees Charged by the Authorities:

  • For output in excess of 1 metric ton and for milk units between 10,001 and 50,000 LPD or 501 to 2500 METRIC TON per year, the Rs. 5,000/- charge shall apply.
  • For output below the 1 metric ton level and for units ranging from 501 to 10.000 LPD, or 2.5METRIC TON to 500METRIC TON per year, a charge of Rs. 3.000/- is payable.
  • Hotels up to four stars are subject to a charge of Rs.5000.
  • All food service providers (Rs 2000) and other food business operators are subject to a fee (restaurants, clubs, restaurants, etc.).

PROCESS OF PROCUREMENT OF THE LICENSE IS AS FOLLOWS:

  • Forms A (demands) are submitted to the Food and Safety Department for FSSAI entry.
  • This request may or may not be approved by the department within 7 days following the date of the request and the fact must be communicated in writing to the applicant;
  • The registration certificate shall be issued by a department with a registration number and a photo of the applicant if the applicant is accepted.
  • The registration certificate at the business site during business hours shall be conspicuously displayed by FBO.

 

CONCLUSION

For any kind of food industry operator in India, whether they are transporters, distributors, producers or caterers, etc., the FSSAI registration or license is essential. Depending on yearly turnover and kind of establishment or company, there are three forms of registration available.
