A consumer complaint can be filed within a period of 2 years from the date of occurrence of defect in the product or service.

Any proclamation written on the shop or on the bill/ invoice such as “Goods once sold will not be taken back” or “No exchange/No refund” amounts to “Unfair Trade Practices” and does not have any legal bearing. In such a case, if the shopkeeper is refusing to exchange the product or refund the amount, you can file a consumer complaint against her/ him.

5. I bought a smartphone which had a 1 year warranty to it. After about 8 months, it started giving problems. I asked the service centre to replace it but they said they would change a part instead. But even after changing the part, it was not working properly. I had to go to the service centre every month and they would change a part everytime. Now it has been a year and they are saying if I get a new part changed, I would have to pay for it since the phone is not covered in warranty. What should i do?

A warranty period means that the defective product would be replaced or repaired within a specified time. Since your product was found defective during the warranty period, the seller was supposed to replace or completely repair it. If they were unable to resolve the problem and it is due to their faulty service that the warranty period expired but the defect in the product could not be cured, it is their duty to replace or repair it free of cost for you. If they deny doing this, you can file a consumer complaint.
