How to take a legal action against Seller?

As a consumer, you have two options- either to keep waiting in anticipation for your undelivered product or take a legal action. If you’re also one of those avid buyers who is waiting for an undelivered product from any of the leading e-commerce websites, here’s what to do: 

  • Contact the seller:  In majority of cases of undelivered product, there is a seller registered on the e-commerce website that sells their product through the online platform. The first step to take in case of undelivered product is to contact the seller who’s selling the product. Any confusions or reason for delay get cleared-up by simply informing the seller. 
  • Contact the e-commerce website’s Customer Care:  When there’s no reply from the seller, contact the customer care of the website. The customer care will contact the seller and the logistics company that delivers the product to solve the issue of non-delivery. Also, when the e-commerce website is directly selling a product, the customer care of the website can be contacted to get your grievance resolved. The Order Number is relevant for any action to be taken.
  • Ask for Refund:  You can also ask for the refund of any advance paid for the product if you do not get it delivered within the stipulated delivery time. The customer care of the website usually refunds the amount paid in advance in case the product is not delivered due to the seller or logistics company’s fault. 
  • Send a legal notice:  If all of the above-mentioned steps are exhausted and no action has been taken by the company to refund your money or attempt to deliver your product, you can hire a consumer court advocate and send a legal notice to the company asking them to take an immediate action. How to file a consumer complaint?

  • District Consumer Dispute Redressal Commission: Cases which have a total value of less than Rs. 25 lakhs can be filed in district CDRC.

  • State Consumer Dispute Redressal Commission: Cases which have a total value of more than Rs. 25 lakhs, but less than Rs. 1 crore can be filed in state CDRC.

  • National Consumer Dispute Redressal Commission: Cases which have a total value of more than Rs. 1 crore can be filed in national CDRC.
