This is my response to you: 1. Send a legal notice; 2. If he does not reply then file a suit for recovery; 3. Also file a police complaint to the nearest police station; 4. You can also claim for the monetary and mental loss suffered by you.

Will I be able to recover money lended to a friend based on trust, utilizing his cheques?

One of my friend asked me to help him with 10 lakh rupees when he was in a distress situation in april 2016. He had one residential property which he had mortgaged to a private finance company but he told me that he was trying to sell this property for a good price so that he could foreclose loan and also return back my 10 lakhs. As a guarantee he just gave me two blank cheques and subsequently somehow he persuaded me and I gave him 10 lakhs by cash merely on trust without any other formalities. This was in August 2016. Though he was trying to find a buyer to sell his property, it didn’t happen and he started giving reasons especially the post demonetization crisis and many others until some one year. When I was in a serious difficult situation, I started pressurizing him to repay, and our relationship got turned bad. As he had defaulted on loan repayment, his property matter went to court for recovery and the finance company is likely to get court order for auctioning it anytime soon. (I came to know this info from the finance office). Now I am again in financial distress and not sure what to do. I have two blank cheques crossed and signed by him. It is Indian Bank current account. No date and no amount is mentioned. I have not yet presented these to bank so far. Do I still have any merit to file a suit in the court utilizing these cheques? I request for advice as to what options I have as per law to get back my money from him. Thanks in advance.

Correct address for court summon

Court asks to provide address of accused (person against whom summon is to be issued) from plaintiff(person who is filing case against accused). How can a plaintiff know the correct address? A criminal won't stay at his/her address after committing crime. He/she would run here and there. How to send summon in that case. I have mobile number of the accused and email id. Its responsibility of court/police to find accused. Police can track the address with mobile number. The accused in a different state. I am filing case from Uttar Pradesh as bank from which cheque was issued is in U.P.
