We have engaged a lawyer in a city other than the city where a civil case is being heard,now this lawyer has engaged another lawyer in the city where the case is being heard.Now that lawyer is not appearing after filing vakalat nama.Now what litigant shoud do & no other lawyer willing take up the case.

Approach your first lawyer and tell him about all this. I am sure he will help you but if doesn't then take no objection certificate from the second lawyer and engage some other counsel. In most of the civil courts No objection is not necessary.

You can take a NOC from that lawyer and search for another. If you are not satisfied then approach state legal services authority.

Gifting back of property

Sir, In family are 2 brothers Rohit & Somesh. Rohit is in defense and Somesh in corporate. There is a plot on name of mother. It is mutual verbally agreed in family to build a house on the plot., Somesh would build home & Rohit to look after all house hold expenses. After that Somesh would gift back the property on mother's name. To execute plan Mother make a gift deed to transfer plot to Somesh to build the home. Rohit also paid home loan fm his savings (bank receipt avl) After settlement of home loan somesh is playing foul and refuses to tx properly. Advice legal options available with Rohit and mother. Mother also wants somesh to tx back property on her name as initially the plot was on her name. Pls advise.

Notice by DDA to vacate flat

My father had purchased a DDA flat from the original allottee in 1992. The flat was allotted in 1991. In 2017, when we applied for freehold, DDA informed that they have not given possession of the flat to the first allottee as some payments were pending. In 2017 they also issued a notice to us to vacate the flat. We gave a reply that we will pay the pending dues and regularise the flat in my father's name. Thereafter, we received a notice last week to come to DDA with original paper. In all these years (25 years) we have never received any notice from DDA to pay the dues or to inform us that they have not given possession of the flat. The notice in 2107 was the first notice. Is DDA right in asking us to vacate the flat after 25 years for non payment of some amount when they had never sent any notice for payment earlier and they got to know about it when we applied for freehold?
