how to file divorce if husband is not agree

I had married 2 months ago but I m not happy with my husband. I have to end our relation.please help me.

You can file divorce under section 13A of Hindu Marriage Act if u are Hndu and Special Marriage Act if otherwise.

Just you got married before 2 months, you can not file Divorce Petitition before 1 year completion, except in some exceptional things hidden by other side like impotency, abnormal etc....Till that period you can file for maintenance to maintain yourself if you are incapable to maintain. Madam, As your marriage is only 2 months old, you cannot file for divorce now. It is mandatory to wait till completion of 1 year of marriage before you can file for divorce. Therefore,wait for another 10 months and thereafter, approach the family court of jurisdiction where you are presently living and file for divorce. However, if after completion of 1 year of marriage, your husband agrees to Mutual Consent Divorce, good, else, file contested divorce petition and proceed further.

YES, You can file a divorce. The law says, that under the grounds of extreme cruelty (be it mental or physical) you can apply for a divorce after bye passing the 1 year period. Of course being Not Happy will not stand as a ground for filing a divorce within just 2 months of marriage. .you need to prove before the court that you have proper cruelty being done on you be it mental or physical cruelty by your husband or in laws. under this circumstances, you can file a Divorce and if the judge is satisfied with the reason, your case can also be admitted

Madam in this case as your marriage is only two months you have to wait for one year in order to file a Petition for divorce and if you want to file within one year you have to file an application to permit you to file Petition and pleading special circumtances for filing it before one year and you cannot wait for one year, further along with the divorce Petition also ask for Permanent alimony or maintenance so that the husband comes forward for divorce or let him pay the maintenance till the case is decided.

You had to wait for one year.. in this case you may just leave your matrimonial house along with dowry articles and file divorce petition after one year... Mean while you may file a complaint against him.under section 498a and maintenence under section 125 crpc

you can't file for divorce after one year in the normal course, but in special circumstances a petition for divorce may be filed with an application under section 14 of the Hindu marriage Act, which may or may not be allowed by the court.

Necessity of FIR & Chargesheet quashing prayers in 482 application

I want to go for FIR and Chargesheet quashing both in my 482 application pending before the Allahabad High Court after a stay of the same as the complaint belongs to repealed Section 66A of the Information Technology Act, 2000. However, these prayers were not specifically mentioned in my revision petition under 482 as it was dismissed by lower Courts. Can I pray the same in my final arguments or I should amend/add my prayer by an application in this regard separately in the High Court?

wife filed false 498a case against me n parents

my wife who is kerala, has filed a false and wrongful case under section 498a against me and my elderly parents.we 3 live in delhi. i received a call from an ASI saying he has received this complaint and me n my parents need to come to his police station in kerala,sign and collect notice.over watsapp he only shared case number and section.he said if all 3 of us dont personally then we will be marked absconding.going to kerala is an expensive proposition not to mention i cannot take leaves and my parents are over 70 and 65 respectively. what should i do step by step
