Sir in this case, you can directly file a case for divorce on ground of cruelty or you can also file a case for restitution of conjugal rights asking the court to join you and lead married life, further regarding her threatening you of filing false cases recently the supreme court has given directions that there will be no automatic arrest in such cases, the court has given guidelines to be followed by police and now if she files a false case and register an Fir you and your family can get anticipatory bail and defend the case, further she may file maintenance or domestic violence case in which no bail is required and you can defend by engaging an advocate, further you can also ask for custody and visiting rights in divorce petition itself.

I live at abroad alone.my wife with her family. she dont want live with me and tried to give false dowry police complaint against my parents. Now i filed divorce case.next month i have 1st hearing. i get fear may she give again false dowry complaint against my parents on 1st hearing.please tell me what are the question will ask to me or what are the procedure in 1st hearing.?

I came to know about my husband's affair after going through his phone. Since a few years his behaviour towards me was very off and caused me a lot of emotional trauma which lead to me spying on him.Since I found out about him, I left him the next day and shifted to my parents house along with my son. I want a mutual separation from him but what will be the scene If he doesn't want to give divorce. How long do I have to wait and how much alimony can I claim

After divorce in India wife can claim for property of husband's brother which was registered by their mother in the name of elder son due to unnecessary harassed by her daughter-in-law during court case for divorce between her younger son and his wife
