Sir in this case, you can directly file a case for divorce on ground of cruelty or you can also file a case for restitution of conjugal rights asking the court to join you and lead married life, further regarding her threatening you of filing false cases recently the supreme court has given directions that there will be no automatic arrest in such cases, the court has given guidelines to be followed by police and now if she files a false case and register an Fir you and your family can get anticipatory bail and defend the case, further she may file maintenance or domestic violence case in which no bail is required and you can defend by engaging an advocate, further you can also ask for custody and visiting rights in divorce petition itself.

sir, in your case, you have got all the rights as stated above in the suggestions but to get these rights activated, you should without making any delay file a police complaint stating these facts and apprehension that your wife may file a false case against you, so that you can be secured against the allegations which she may put on you. feel free to ask for further assistance. In case you wish to stay with her, and she has withdrawn from her matrimonial obligations without reasonable cause, you can file a petition for restitution of conjugal rights. However in case there is no scope of reunion, both the parties should try and separate amicably. Filing a False FIR against Husband and in-laws is a common practice these days, however, filing a false FIR is still easy but proving it in court is a herculean task. By way of abundant caution you can file a NCR complaint in the concerned police station, stating that you are receiving such threats. However considering the time you have spent together and the interest of the infant child it would be best if you try separation through mutual consent. Best! Atul Singh, Advocate

How much time it will take and how much money it will consume

I am a defence employee and I got married on 4th may 2017 and we don't have any kids. Our thinking and lifestyle don't match. She is very much expensive, foodie and traveller type girl. I don't like all these things. She want me to stay away of my family as she and her family is isolated from her family. We don't like each other's family. She had never stayed with my family after marriage still She doesn't like them. We have our elder brother's wife also at our home who got married after us and she is living happily with my parents. She insisted me to marry her before my elder brother. Actually we started talking to each other before engagement so I couldn't resist myself to marry her before my elder brother's marriage. I have already purchased a plot on her name costing around 15 lakhs. She has already shifted around 4.5 lakhs jewellery and clothes worth rupees 50 thousand to her mother's home which was given by us. She is ready for mutual consent divorce as she got sufficient amount at her side. Now I don't have anything to give her as Iam well pressed by four loans. I just want her to go away from my life.
